Eligibility: Open to citizens and permanent legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age and of the Age of Majority, per the laws of their state of legal residence, or older (hereafter "entrant"). A valid email address is required for entry. Employees of the Sponsor, their suppliers, partners, advertising and promotional agencies, any agents acting for, or on behalf of the above, their respective parent companies, officers, directors, subsidiaries, franchises, affiliates, licensees, service providers and/or members of their immediate families (parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses) and/or persons living in the same household as such persons, whether or not related, are ineligible to enter the Sweepstakes.
Promotion Description: The Englin's Online Shopping Spree (hereafter "Sweepstakes"). By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at customerservice@englinsfinefootwear.com during the Promotion Period.
Sweepstakes Period: For all purposes of this Sweepstakes, the Sponsor's computer is the official clock and all times refer to Eastern Time (hereafter "ET"). The Sweepstakes period begins 12:00:00 am ET on October 1, 2017 and ends at begins 11:59:59 pm ET on December 31, 2017 (hereafter "Sweepstakes Period")
How to Enter: Enter the Sweepstakes during the Promotion Period online via pop-up entry form on https://englinsfinefootwear.com/, by completing the entry form at englinsfinefootwear.com/something. Alternate entries can be made by calling 1-800-705-7463, or by emailing customerservice@englinsfinefootwear.com, and providing a valid email address. A valid email address is required for entry. Only one (1) entry per person by any means. Duplicate entries will be removed. Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant's Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Sweepstakes Period in order to participate. Sponsor's clock will be the official timekeeper for this Sweepstakes.
Prizes: Each month of the Sweepstakes period one (1) winner will receive $200 USD in online store credit to be used solely at englinsfinefootwear.com. Not valid in retail stores. Partial credit can be used until the entire amount has been spent. Not redeemable for cash. Store credit does not expire. Can only be used for in-stock merchandise. No special orders. Each entrant is eligible to win only one (1) prize during the Sweepstakes Period. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason.
Odds of Winning: Odds of winning prize depend on number of eligible entries received.
Winner Selection: Each month, one (1) winner will be selected in a random drawing from among all eligible Entries received throughout the Sweepstakes Period. The random drawing will be conducted on or before the fifth (5th) business day following the end of each month of the Sweepstakes Period by the Sponsor or its designated representatives, whose decisions are final.
Winner Notification: Winner will be notified by email at the email address provided in the Entry Information within forty-eight (48) hours after the random drawing. Potential Winner must accept a prize by email as directed by Sponsor within seven (7) days of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account. Any winner notification not responded to or returned as undeliverable will result in prize forfeiture and a new winner will be selected by a random drawing from among all eligible Entries received throughout the Sweepstakes Period by the Sponsor or its designated representatives, whose decisions are final. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (hereafter collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by Sponsor.
General Rules and Conditions: All applicable federal, state and local laws apply. By participating in this Sweepstakes, entrants agree to abide by and be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes. Promotion Parties are not responsible for: (i) electronic or digital transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected or for non-delivered or postage-due mail; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures (including but not limited to failures or malfunctions of phone lines, telephone systems or other communications systems), destruction of or unauthorized access to, or alteration of, entries, or for printing, distribution or production errors; (iii) failed or unavailable hardware, network, software or telephone transmissions; (iv) damage to entrants' or any person's computer; (v) causes beyond Promotion Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion; (vi) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Promotion; (vii) any typographical or other error in the printing or advertising related to the Promotion, in the administration or execution of the Promotion, or in the announcement/notification of prize winners; (viii) by any human, or other error, which may occur in this Promotion or (ix) cheating or fraud by any participant. All incomplete or non-conforming entries will be disqualified. If for any reason this Promotion cannot be executed as planned, including but not limited to infection by virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor or Promotion Administrator that corrupt or affect the security, administration, integrity, fairness or proper conduct of this Promotion, or if this Promotion is compromised or becomes corrupted in any way, electronically or otherwise, Promotion Administrator reserves the right, in its sole discretion, to void suspect entries/entrants and/or modify, suspend and/or terminate this Promotion. If the Promotion is terminated before the stated end date of the Promotion Period, the Promotion Administrator will select any remaining winners in a random drawing from among all eligible, non-suspect entries received through all entry methods combined as of the time/date of termination. Promotion Administrator reserves the right, in its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the entry process, who acts in a disruptive or unfair manner, or who attempts to enter using any automatic or programmed entry method, or any entry service. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND/OR PROMOTION ADMINISTRATOR RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be declared made by the person in whose name entry was made.
Privacy: The personal information collected through this Sweepstakes is subject to the Sponsors Privacy Policy located at https://englinsfinefootwear.com/privacy-security/. By entering this Sweepstakes, entrants agree to the use of their personal information as described in the above Privacy Policy.
Future Offers: By entering this Sweepstakes, entrants agree to the Sponsor's use of email addresses for its direct marketing purposes, including but not limited to emails about future promotions. Entrants may opt out of receipt of emails and other offers by clicking on the unsubscribe link at the bottom of the Sponsor's promotional email or emailing customerservice@englinsfinefootwear.com and asking to unsubscribe.
Permission to Publish: Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winner's names, voices and/or likenesses for purposes of advertising and publicity in all media now known or hereinafter invented without territorial or time limitations and without additional compensation or notice, unless prohibited by law.
Limitation of Liability: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Sweepstakes.
Mobile Fees: Entries submitted via mobile device are subject to standard messaging/data rates, terms, and conditions, of the mobile service provider. Entrants should contact their mobile service provider regarding any questions concerning their bill.
Governing Law/Jurisdiction and Arbitration: Any controversy or claim arising out of or relating to (i) the Sweepstakes, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the state of Indiana without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. Any controversy or claim arising out of or relating to this agreement, its enforcement, arbitrability or interpretation shall be submitted to final and binding arbitration, to be held in Delaware County, Indiana, before a single arbitrator. The arbitrator shall be selected by the Sponsor. The arbitration shall be a confidential proceeding, closed to the general public. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator's award is based. The Sponsor and the entrant or entrants bringing forth the controversy or claim (hereafter collectively, the "Parties") will share equally in payment of the arbitrator's fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert and attorneys' fees and other expenses to the same extent as if the matter were being heard in court). Entrant(s) agrees that his/her claim will be resolved individually, exclusively by arbitration, without resort to any form of class action. Entrant(s) further agrees that any claim/judgment/award in such arbitration shall be limited to actual out- of-pocket costs incurred, including costs associated with participating in the Sweepstakes but in no event attorneys' fees; and, under no circumstances, will an entrant(s) be entitled to awards for and entrant(s) hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
Severability: Should any term of these Official Rules be deemed void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring that term within the requirements of law, be deemed to be severed from the other terms of these Official Rules, and the remainder of these Official Rules shall be given effect as if it had not included the severed term herein.
